BE IT ORDAINED by the City Council of the City of Huntsville, Alabama as follows: Section 1. Fiber Utility Network, Inc., d/ b/ a. Alabama Fiber Network, Inc., an Alabama corporation, (” Alabama Fiber”) may utilize the rights -of -way in the corporate limits of the City of Huntsville, Alabama, (” City”) in order to construct its network and to provide its communications services in accordance with and subject to the terms and conditions of the Rights -of -Way Use Agreement between Fiber Utility Network, Inc., d.b. a. Alabama Fiber Network, Inc., and the City of Huntsville, Alabama, to be executed by the City and Alabama Fiber (” Use Agreement”).
